These Terms and Conditions (the "Agreement") constitute a legally binding agreement between the Member or User ("You," "Your," or "Member") and Stone Studios ("Stone Studios," "We," "Us," or "Our") for the use of studio spaces, including podcast studios, content corners, and related amenities (the "Premises"). By creating an account through our booking platform, purchasing credits, booking space, or accessing the Premises, you agree to be bound by this Agreement.

All members must create and maintain an active user account on our official booking platform to access the Premises. Bookings, payments, cancellations, and credit management will only be processed through this system.

1. USE OF THE SPACE

Stone Studios provides flexible-use content creation spaces including podcast rooms and content corners. Members may use their credits to access these areas exclusively. Members may not film, record, or produce content in public/common workspaces unless specifically authorized or during an approved content event.

Use of space is subject to availability and booking confirmation through our official booking system. Studio bookings are capped at a maximum of three (3) hours per day per room, and fifty (50) hours per calendar month. Members must request approval for bookings longer than three (3) hours by contacting Stone Studios in writing. 

No guests are permitted on the Premises unless:

• You have received prior written approval from Stone Studios; or

• A "Free Guest" promotion is active and applied to your booking.

Stone Studios reserves the right to remove or ban any Member or guest who violates the policies outlined herein.

2. MEMBERSHIP CONDUCT AND REGULATIONS

To maintain a safe, respectful, and productive environment for all creators:

• Noise must be kept at a moderate level. Excessive shouting, loud music, or disruptive behavior is not permitted.

• Members must clean up their space after each session.

• Use of props and equipment must be supervised and returned in proper condition.

• Any form of harassment, discrimination, or hostility will result in immediate removal.

Inappropriate content is strictly prohibited and includes, but is not limited to:

• Adult or sexually explicit content

• Racist, sexist, or hate-promoting material

• Illegal activities or incitement thereof

Violation of these guidelines may result in immediate termination of access without refund or notice.

3. PRIVACY POLICY

Stone Studios is committed to protecting your privacy. We collect personal information necessary to manage bookings, payments, and communication. All data is processed in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

We do not sell or share your personal data with third parties without your consent, except where required by law. Security cameras may operate in common areas for safety monitoring.

4. CONTENT USE AND OWNERSHIP

All content created by you within the space remains your property. However, by using the Premises, you grant Stone Studios a non-exclusive, royalty-free, worldwide license to use, reproduce, and repurpose any content publicly shared or tagged with Stone Studios branding for marketing, promotional, or operational purposes.

This includes, but is not limited to:

• Reposting your content on Stone Studios' social media

• Featuring your content on our website or booking platform

• Using your content in promotional materials

If you wish to opt out, you must notify Stone Studios in writing prior to your session.

5. CREDITS AND REFUND POLICY

All bookings require the use of pre-purchased credits. Credits are non-refundable, non-transferable, and expire 45 days after purchase unless otherwise specified in a promotion.

Booking cancellations made more than 24 hours in advance will retain full credits. Cancellations within 24 hours will result in a 50% credit forfeit. No-shows forfeit 100% of booking credits and may lose future booking privileges. Members must contact us in writing via email in order to cancel, if the member does not contact us within the reasonable time thresholds listed above, it will be considered a no-show.

Stone Studios operates on a credit-based booking system for members and a direct booking option for non-members.

Members are required to create an account and will receive a unique package code corresponding to their selected membership plan. This code enables members to book access to any available studio space using a credit system, where 1 credit is equivalent to 60 minutes of studio use. Members can view their remaining credits through their account dashboard and are responsible for monitoring their available time. Additional credits may be purchased at any time via the top-up option.

All member credits are valid for a period of six (6) months from the date of the package purchase, unless otherwise stated in your account. Unused credits will automatically expire after this period and are non-refundable.

Non-Members may book studio spaces on a one-time basis by selecting and paying for a session directly from the available booking list. Non-members do not receive credits or access to member-exclusive benefits. To access more flexible usage and cost savings, non-members are encouraged to enroll in one of Stone Studios’ membership packages.

All bookings, whether made by members or non-members, are subject to Stone Studios’ general booking policies, space usage guidelines, and cancellation terms. Stone Studios reserves the right to change the timeframes of studio use with notification. 

6. DEPOSIT STRUCTURE

A refundable deposit may be required for first-time bookings or for bookings involving add-on services such as props or premium equipment. Deposits are held on your account and returned within five (5) business days after inspection. Members are required to keep a valid credit card or debit card on file/account.

Stone Studios reserves the right to withhold all or part of the deposit for any policy breach, overage, or damages.

7. DAMAGES AND LIABILITY WAIVER

Members agree to use the Premises and all equipment at their own risk. Stone Studios is not liable for any injury, loss, theft, or damage to personal property.

Stone Studios is not liable for any loss of income, opportunity, or consequential damages arising from or related to the use of the Premises.

Members shall be responsible for any damage caused to the Premises, including furniture, walls, props, or electronics, and will be invoiced for the cost of repair or replacement.

By agreeing to these Terms, you release and discharge Stone Studios, its staff, and affiliates from all claims, damages, or liabilities arising out of or related to your use of the Premises.

8. OVERAGE FEES

A 15-minute grace period is allowed after the scheduled end time. Any session exceeding this grace period will be charged at 1.5 times the standard credit rate for each additional 30 minutes. In the event of physical damage caused during the overage period, the Member will also be financially liable for repair or replacement.

All payments must be completed virtually through the designated booking system. A valid credit or debit card must be kept on file. Failed membership payments or declined transactions will incur a Non-Sufficient Funds (NSF) fee of $25. Continued failed payments may result in suspension of access and services.

9. REFERRAL PROGRAM

Members may participate in Stone Studios’ referral program. For each successful referral (i.e., when the referred party books and completes a session), the referring member will receive one (1) bonus credit.

Referral bonuses are subject to verification and may be revoked in cases of fraud, self-referral, or abuse. Referral terms are subject to change without notice.

10. MODIFICATION AND TERMINATION

Stone Studios reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website and emailed to members. Continued use of the Premises constitutes acceptance of the revised terms.

Stone Studios also reserves the right to suspend or terminate a Member’s access for any violation of these Terms or for behavior deemed inappropriate or unsafe.

11. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

By using or accessing Stone Studios, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
